A fight that started over a couple dancing at a 1-year-old’s birthday party ended with one dead, two others wounded and a third man charged with first-degree murder.
Oscar Villegas-Ortega, 21, was charged Friday with murder in connection with the June 27 shooting death of Fausto Marquez, 30, according to a news release from the Denver district attorney’s office. He also faces charges of possession of a weapon by a previous offender and violating bail conditions.
The shooting happened at 10:12 p.m. in the parking lot of the Old West Pancake House, 3600 Park Ave. West, where a family had rented a back room for the child’s party, according to an arrest warrant affidavit. Police found Marquez lying in the parking lot with a gunshot wound to his chest. Two other people suffered stab wounds and were treated at a hospital. Villegas-Ortega also was injured, according to the affidavit, which described the scene as chaotic.
Witnesses said the fight started because Villegas-Ortega danced with the child’s mother, who is a cousin, to a live band’s music. Other men at the party became upset over their dancing, and a fight broke out, the affidavit said.
The fight spilled into the parking lot, where Villegas-Ortega allegedly pulled a gun and fired at least two shots. Police found a gun in Villegas-Ortega’s pants pocket, and shell casings found at the scene matched the gun’s caliber, the affidavit said.
The shooting death happened during a streak of homicides that has Denver on pace to record its most deadly year in a decade.
